REGISTRATION AND PARTICIPATION CONDITIONS FOR THE XVII MALLORCA 312 OK MOBILITY

ARTICLE 1. APPLICATION:

These conditions complement the provisions already established regarding the general conditions contained in the Legal Notice of the website www.mallorca312.com (hereinafter, the WEBSITE), owned by 312 Bike & Tours S.L.U. (hereinafter, 312 Bike & Tours), to which reference is made for any matters not stipulated in these terms and conditions of use of the registration platform. Users are strongly advised to read and keep a copy of these terms and conditions of use, as well as the website's legal notice.

ARTICLE 2. IDENTIFICATION OF THE PARTIES:

On the one hand, 312 Bike & Tours, with registered office at Carrer de les Parres, 51, 07570, Artà, Balearic Islands, registered with the Commercial Registry of Palma de Mallorca on 7 July 2016, in Volume 2,666 of the Registry, General Section, folio 26, section 8, sheet number PM-79.193, entry 1, and fiscally identified by the Spanish Ministry of Economy and Finance with Tax Identification Number (CIF): B-57.967.622.

On the other hand, the User, who accesses the platform to register for the XVII MALLORCA 312 OK MOBILITY. The User declares that they are of legal age (over 18 years old) and have the legal capacity necessary to enter into contracts, register for and participate in said event, expressly understanding and accepting the conditions detailed below. In the event that the User is a minor, registration shall always be carried out under the supervision of their parents or legal guardians, with their consent and under their responsibility.

ARTICLE 3. CONDITIONS OF PARTICIPATION IN THE XVII MALLORCA 312 OK MOBILITY:

The User declares that they have read, are aware of and accept all the conditions contained in the Rules and Regulations of the event and in this document.

Furthermore, and in particular, the User declares that they have read, are aware of and accept the following conditions of participation in the XVII MALLORCA 312 OK MOBILITY:

  1. The User will participate on 24 April 2027 in the XVII MALLORCA 312 OK MOBILITY, in any of its three routes of 312, 226 or 167 km. Once the ride has started, the participant may change distance without having to notify the organisation.
  2. The User declares that they are aware of the contents of the Rules and Regulations of the event (link to the Rules and Regulations of the event), which they fully accept. The User is informed that the cycling event shall be subject to the provisions specified in its Rules and Regulations, and that such provisions may be modified, for example with regard to start times, final routes, etc., depending on justified circumstances, such as administrative requirements, road conditions, weather conditions, etc.
  3. Registrations are strictly personal and non-transferable and may not be used by anyone other than the registered participant. The substitution of one participant by another is not permitted. The participant must personally attend to collect their race number, with valid identification (national identity card or passport). The race number and participant bag MAY NOT be collected by third parties. Only registrations duly paid by credit and/or debit card through the payment gateway proposed by the organisation will be accepted; that is, THERE IS NO possibility of pre-registration and payment when collecting the race number in person.

ARTICLE 4. REGISTRATION PROCESS:

The registration process consists of the following steps, listed chronologically from 1 to 10:

  1. Once the registration process has started, the User is redirected to the registration platform. The User must expressly accept these terms and conditions of use of the registration platform, the general conditions of the website, the Rules and Regulations of the event and the privacy policy.
  2. If the User has a registration code, they must enter it. If they do not have one, they will continue with the standard process.
  3. If the User has registered for previous editions, the system may automatically complete certain details using their tax identification number or passport. In such case, the User is responsible for reviewing and accepting them, as the absence of errors cannot be guaranteed.
  4. If the User has not registered for previous editions, they must complete the fields with their personal details, postal details and the details of the designated emergency contact person, including their telephone number. The User is responsible for obtaining the consent of such person for the transfer of their data, and shall in all cases be subject to the website's privacy conditions.
  5. The User will have the option to indicate whether or not they are federated with the RFEC. If they are not federated with the RFEC, the User shall assume payment of the mandatory insurance fee of 15 euros in order to participate in the event. The fact that the User is federated outside Spain, or that the User is federated with a federation other than the RFEC (for example, athletics or triathlon), shall not exempt them from paying the mandatory insurance fee of 15 euros in order to participate in the event. In cases other than an RFEC licence, the User shall assume payment of the mandatory insurance fee of 15 euros in order to participate in the event.
  6. The participant will select their jersey size during the registration process. This size may subsequently be modified while the registration platform allows such change to be made. Once the modification option is no longer available on the platform, the deadline for requesting size changes shall be deemed to have expired and no subsequent modifications will be accepted.
  7. The User will have the option to purchase or not certain goods and services complementary to the registration process, as well as to voluntarily make a contribution to 312 Solidària: Climent Alzamora. Both the purchase of these goods and services and the making of such contribution shall be voluntary, and it shall not be necessary to make use of these options to complete the registration process.
  8. Once the above steps have been completed, the User will be directed to the payment gateway to make payment by credit card. The User shall be responsible for accepting or not accepting any conditions that may be established by the payment gateway and which are outside the control of 312 Bike & Tours, without prejudice to those contained in Clause 4 of these terms and conditions of use.
  9. Once payment has been made, confirmation will be received by email sent by the platform to the email address provided by the User. The registration process cannot be considered completed until such confirmation has been received. If such confirmation is not received, the User must contact the organisation via the following email address:info@mallorca312.com
  10. If the RFEC continues to deem it appropriate, the User who is federated with the RFEC must complete the Responsible Declaration and Personal Location Form (FLP). To do so, they must access the private area of their Federation with a user account through the following link:https://rfec.com/index.php/smartweb/auth/acceso_federacion.

In the case of participants under 18 but over 15 years of age, once the registration procedures on the registration platform have been completed, the legal guardian shall request a parental or legal guardian authorisation form for the minor by sending an email to info@mallorca312.com, indicating the registration number and the details of the minor, as well as those of the guardian. This authorisation must be duly signed and scanned and sent to info@mallorca312.com within twenty days following completion of the registration procedures on the registration platform and payment of the registration fee. Once this period has elapsed, the registered participant shall be deemed to have waived their registration and all rights arising from participant status, including the waiver of collection of the participant bag.

ARTICLE 5. PAYMENT CONDITIONS:

The User declares that they have full capacity to use credit cards and states that the card to be used is exclusively in their name.

The data recorded by the website and/or the payment gateway constitute proof of the transactions carried out between the website and the Users.

For your security, 312 Bike & Tours has entrusted credit card payments to a payment gateway. The banking details entered are encrypted and securely transmitted to the servers of the banking institution and subsequently verified with the issuing bank in order to prevent possible fraud and abuse.

This data entry procedure is guaranteed by SSL (Secure Socket Layer) -128-bit encryption technology.

ARTICLE 6. COST FOR THE PARTICIPANT:

6.1. The total cost for the participant (including the registration and race number fee, the purchase of the official event jersey and registration platform fees) is as follows: €169.99

6.2. In order to participate, it is mandatory to be federated with the RFEC or for the participant to assume payment of the mandatory insurance fee of 15 euros in order to participate in the event. The fact that the User is federated outside Spain, or that the User is federated with a federation other than the RFEC (for example, Real Federación Española de Triatlón (RFET), Real Federación Española de Atletismo (RFEA), Federación de Cicloturismo (FCT), shall not exempt them from paying the mandatory insurance fee of 15 euros in order to participate in the event. In cases other than an RFEC licence, the User shall assume payment of the mandatory insurance fee of 15 euros in order to participate in the event. Participation in the event is under the responsibility and at the own risk of the participants. Under no circumstances will the amount of 15 euros corresponding to the insurance be refunded in the case of a participant who indicated that they did not have a licence and subsequently obtained one.

6.3. The total cost for the participant includes the registration fee, the purchase of the official event jersey and registration platform fees, broken down as follows:

  1. a) Jersey price: €50
  2. b) Platform fees: €15
  3. c) Registration fee: €104.99

6.4. Since the purchase of the official jersey is mandatory for the event, the participant will receive a single charge for the participation cost, the total cost for the participant as defined in point 6.1 above.

ARTICLE 7. RACE NUMBER COLLECTION:

Race numbers may be collected on Thursday 22 April and Friday 23 April 2027, at the Mallorca 312 EXPO, from 9:00 a.m. to 9:00 p.m.

ARTICLE 8. RIGHT OF WITHDRAWAL:

The User may withdraw from their registration without giving any reason within 14 calendar days from the date on which the registration was formalised. They must submit their withdrawal request by email to info@mallorca312.com, stating their intention to withdraw from the registration and attaching a copy of the email confirming their registration. 312 Bike & Tours will refund the registration fee no later than 14 days following the date on which the aforementioned notification is received, by refunding the amount to the bank card used to make the payment. No refund will be processed if this procedure is not followed or if the request is made after the deadline.

ARTICLE 9. EVENT NON-HOLDING:

The Organisation, advised by bodies linked to Civil Protection, may order the partial or total suspension of the ride if it has sufficient information regarding risks that may affect the safety of participants or collaborating staff. These risks may be associated with Force Majeure Events[1] or Adverse Weather Conditions, or any other circumstance affecting the safety of participants and/or spectators of the event or which may prevent it from taking place.

In the event that the event is cancelled due to force majeure and/or weather-related causes, before the event begins, the participant shall be entitled to a refund of the registration and race number fees, but under no circumstances shall the management fees or the price of the jersey be refunded, in which case the Organisation shall send the jersey to the participant, with the Organisation bearing the shipping costs.

In the event that the event is suspended due to force majeure and/or weather-related causes, once the event has started, whether on the initial date or on the alternative date, the participant shall not be entitled to a refund of the registration or race number fees, nor shall the management fees or the price of the jersey be refunded under any circumstances. For the purposes of this paragraph, the event shall be deemed to have started when the distribution of race numbers begins.

In the event that the event is suspended and postponed due to force majeure and/or weather-related causes, before such suspension and postponement take place and before the event begins, the participant may choose to continue with their registration for the new date at no additional cost, or expressly state that they will not participate, in which case their race number will be cancelled and they shall be entitled to a refund of the registration and race number fees, but under no circumstances shall the management fees or the price of the jersey be refunded, in which case the Organisation shall send the jersey to the participant, with the Organisation bearing the shipping costs.

[1] Force majeure shall mean circumstances reasonably beyond the control of the Organisation, such as heatwaves, tornadoes, earthquakes, storms, strong winds, hailstorms, fires, lightning, floods, accidents, road closures, civil unrest, criminal or terrorist acts of any kind or other acts of government, pandemics and health emergencies, or any other circumstance beyond the direct control of the Organisation.

ARTICLE 10. MARKETPLACE:

Any participant wishing to cancel their registration will have the option of selling it through the official Marketplace, which will be available from 1 December 2026 to 31 March 2027.

Once the change of ownership has been made and the new participant purchases the registration, the corresponding refund will be processed, excluding the management fees (%), to the same card used for the initial payment.

The management fees shall be as follows:

From 1 December to 1 January: 20% of the registration cost

From 2 January to 28 February: 30% of the registration cost

From 1 March to 31 March: 40% of the registration cost

The Marketplace shall be the only means through which a registration may be put up for sale, and the Organisation shall process the corresponding refund once the sale has been completed. The exchange of race numbers between participants outside the Marketplace is not permitted.

ARTICLE 11. STARTING BOX CRITERIA:

Participants will be assigned to one of the starting boxes according to the following criteria:

  1. VIP BOX: VIP participants
  2. BOX 1: Sponsors
  3. BOX 2: Participants with the best times recorded at Mallorca 312, 226 and 167 in the last two editions, as well as participants with a booking made through SCIO ProCycling for packages including accommodation at GRUPOTEL hotels (up to the capacity limit).
  4. BOX 3: Finishers from the last two editions and ‘lucky spots’
  5. BOX 4: Remaining participants

The boxes have limited capacity. If, for any reason, the capacity of a box is exhausted, these conditions may be modified.

ARTICLE 12. PERSONAL DATA:

In accordance with the provisions of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter, LOPD) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, better known as the General Data Protection Regulation (hereinafter, GDPR), as well as the regulations implementing it, 312 BIKE & TOURS, S. L. informs you that the personal data obtained through the registration platform will be included in an automated file whose Controller is 312 BIKE & TOURS SLU (hereinafter, 312 Bike & Tours), with registered office at Carrer de les Parres, 51, 07570, Artà, Balearic Islands, registered with the Commercial Registry of Palma de Mallorca on 7 July 2016, in Volume 2,666 of the Registry, General Section, folio 26, section 8, sheet number PM-79.193, entry 1, and fiscally identified by the Spanish Ministry of Economy and Finance with Tax Identification Number (CIF): B-57.967.622.

The collection and automated processing of Personal Data are intended to manage the relationship with the User, as well as information and marketing activities relating to the service and activities related thereto, and for statistical purposes and to improve the quality of the service.

The personal data provided by the User shall be understood to be truthful and accurate, and the User shall be solely responsible for ensuring that the information provided is real and truthful. The period for which the personal data collected through the form will be retained shall be four years once the User has unsubscribed.

312 Bike & Tours undertakes to comply with its obligation of confidentiality regarding personal data and its duty to safeguard such data and shall adopt all technical and organisational measures to guarantee the security of personal data and prevent its alteration, loss, processing or unauthorised access, taking into account the state of technology, the nature of the stored data and the risks to which they are exposed, all in accordance with the provisions of the GDPR.

The Website has the information security measures generally used to prevent unauthorised access to personal data.

The User consents to the processing of the personal data they have voluntarily provided, following their express consent, for the purpose of sending them information by any means regarding our products, services, offers or special promotions, for which purpose we may create User profiles that allow us to make personalised offers. These communications will include the word ADVERTISING.

Likewise, we inform you that such data may be transferred, and the User expressly consents to such transfer, for the purposes mentioned above to the company SCIO PROCYCLING (hereinafter, SCIO ProCycling), whose activity is that of a retail travel agency specialising in sports tourism, for the purpose of communicating tourism and sports-related offers and promotions, as well as for statistical purposes and to improve the quality of the service. Consent to the communication of personal data is revocable. SCIO PROCYCLING undertakes, solely by virtue of the communication of the data, to comply with the provisions of the GDPR.

Likewise, we inform you that such data may be transferred (provided that you have given your express consent) for the purposes mentioned above to the company OK MOBILITY GROUP SAU (hereinafter, OK MOBILITY), whose main activity is to provide mobility services, for the purpose of communicating informative and commercial offers and promotions, as well as for statistical purposes and to improve the quality of the service. Consent to the communication of personal data is revocable. OK MOBILITY GROUP SAU undertakes, solely by virtue of the communication of the data, to comply with the provisions of the GDPR.

Except for the provision above, the personal data that you have voluntarily provided to 312 Bike & Tours shall not be transferred to any other person or company, except in specific cases where such transfer is permitted under the GDPR. However, without prejudice to the foregoing, the User accepts the transfer to third parties of the data they have voluntarily provided that are strictly necessary for the provision of the requested service.

We inform you that, in accordance with the GDPR, you may exercise your rights of access, rectification, erasure, restriction of processing, data portability and objection to any consent granted, free of charge, by sending a written request to 312 Bike & Tours at its registered office at Carrer de les Parres, 51, 07570, Artà, Balearic Islands, or by sending an email to the following address: info@mallorca312.com.
